Ballot Access

Motions Filed! Motions Filed!

On May 8, the lawyers representing the Indiana Green Party filed our Motion for Summary Judgment and Memorandum in Support. This motion is moving our case against the difficult ballot access laws in Indiana forward. Included in the filing were 17 sworn declarations in support of our claims. In total a compelling amount of evidence has been submitted that Indiana laws limit minority and independent candidates from the ballot by imposing excessive requirements. The Indiana Green Party has presented a strong case.

Our motion asks the Court to declare Indiana's ballot access requirements -- specifically the 2-percent signature requirement, the 2-percent vote test to retain ballot access, the June 30 filing deadline and the in-person, paper petitioning procedure -- unconstitutional as applied to minor party and independent candidates. If the Court grants the motion, in whole or in part, the challenged provisions will not be enforceable.

But first the Indiana Attorney General has to file his own Cross-Motion for Summary Judgment and both motions must be fully briefed. That process could conclude as early as this summer. The Court will then either schedule oral argument or rule on the pending motions based on the filings alone.

The Indiana Green Party has made substantial gains toward a more fair and inclusive democracy in Indiana. Our commitment to both the voters and the values of the Green Party movement. You can support this important work for Ballot Access in Indiana by making a contribution to our special Ballot Access fund that is making this amazing step forward for our Party possible.
